Workforce Solutions Seeking Those Denied Benefits

New Mexico Legal Aid recently became aware that the NM Department of Workforce Solutions has issued a form letter notifying certain former UI applicants who were denied benefits during the Pandemic of their right to apply retroactively for a federal disaster relief benefit called PUA, or Pandemic Unemployment Assistance. According to the letter, dated March 29th, it appears that those to whom the Department sent the notice were identified in an audit aimed at finding those claimants who were potentially eligible but not allowed to apply for PUA benefits prior to the program’s expiration on September 4, 2021. The Department is now allowing those who it identified to apply retroactively. To qualify for these retro benefits, claimants must not have been eligible for regular unemployment benefits and have been unemployed, partially unemployed, or unable or unavailable to work because of certain health or economic consequences of the COVID-19 pandemic.
